Trade Marks:
Trade Marks are used to protect brand names and other features of a product that are distinctive. Brand names, logos, 2D and 3D shapes, sounds, smells, colours may be protected. We also provide filings for international trade mark applications (Madrid applications). Please note that New Zealand is not yet a member of the Madrid protocol. Australia is a member, and international applications are filed using Australia as the home country for the application.

Trade Mark filings:
We register trade marks in Australia and New Zealand. We offer discounts if registration of the same mark is undertaken in both territories. We also file international (Madrid) trade mark applications via Australia. Please note that New Zealand is not yet a member of the Madrid protocol. We offer fixed fees for trade mark applications. The fee includes filing the application, prosecution (if any) and registration formalities. Additional fees are only raised if any of the following are necessary : a hearing, a removal application (to remove a cited mark which cannot be otherwise overcome), filing of evidence of use, filing or defending oppositions or revocation applications. Our fees are fixed per trade mark and we do not add additional fees for additional classes or additional marks in a series.

Patents:
Patents are granted for a finite term of up to 20 years from the date of filing a patent application. Patents protect ideas (how something works). To file a patent, a patent specification needs to be prepared. A patent specification is a detailed document that sets out the invention, including the claims to the invented monopoly sought. Patent specifications are both legally and technically complex and should be prepared by qualified patent attorneys.
